What is the Difference between Statutory, Case, Positive, Civil and Common Law
Law is the name of such system that is applied by state government and comprises of some guidelines and rules that are enforcedly applied upon the people. There are various types of law and each type is related to some particular nature of crimes and also put up in front of different types of judiciary. Statutory Law
Statutory Law is such type of law that is passed by government officials, legislature or even legislator. This type of law is categorized as subsidiary of higher law.
Case Law
Case law comprises such piece of writings or documents that describe the final decisions of any case and is written by judges.
Positive Law
Positive law means such types of man-made rules and regulations that are applied upon any specific group of people either in their favor or in opposite to them.
Civil Law
Civil law comprises of such rules that are collection and restatement of jurisdiction law. It is very near to Roman law and consists of the procedure in which written collections of law are provided to citizens.
Common law
Common law means those orders that are applied on upon people by the order of judges under the final decision of courts.
Statutory vs Case vs Positive vs Civil vs Common Law
Statutory law simply means such order or group of orders that are concerned with the orders of legislators or legislatures in contrast to common law that is directly applied by judges in the light of court orders. Case law is the written form of orders that are approved by judges in contrast to civil law that is the codified collection and supplied to common citizens. On the other hand, positive law is the name of man-made law that are approved in the favor or opposition of any group of people.
